Terms and conditions of use (as at January 2005):

1. Area of application

Any use of these Internet pages provided by Comarch Software und Beratung AG and/or its subsidiaries (hereinafter also referred to as "Comarch") is permissible exclusively on the basis of these conditions. By logging in, or if a separate log-in is not required, by initiating use, the user accepts the validity of these terms and conditions of use in their current version.

2. Content of the Comarch Website

Comarch Software und Beratung AG gives no guarantee of any kind regarding the relevance, correctness, completeness or quality of the information provided. Comarch makes no assurances of any kind and undertakes no guarantee of any kind in regard to the accuracy or reliability of the information and contents contained on this Web site, passed on via this Web site or downloaded, referred to, or accessed on this Web site. Liability claims against Comarch Software und Beratung AG relating to damage of a material or immaterial nature occasioned by the use or non-use of the information provided or by the use of defective and incomplete information are excluded as a matter of principle, unless demonstrably deliberate or grossly negligent fault exists on the part of Comarch Software und Beratung AG. All information offered is subject to change without notice and is non-binding. Comarch Software und Beratung AG explicitly retains the right to change, supplement, or delete parts or the entirety of Comarch Web pages without making a separate announcement, or to cease publishing them temporarily or definitively. 3. Liability on the basis of references and links

All brands and trademarks mentioned within the Internet offering, which may be protected by third parties, are unrestrictedly subject to the applicable provisions of the labelling rights and ownership rights of their respective registered owners. It should not be concluded from the mere mention that trademarks are not protected by rights of third parties. The copyright for objects prepared and published by Comarch Software und Beratung AG itself remains solely with Comarch Software und Beratung AG. No exploitation of such graphics, audio documents, video sequences or texts, such as copying, editing or reproduction, is permitted without the express consent of Comarch Software und Beratung AG. Apart from the rights of use or other rights explicitly granted here, the user is granted no further rights of any nature, in particular rights to the company name or commercial property rights such as patents, utility models or trademarks, nor does Comarch have any obligation to grant such rights.

6. Legal effect, place of jurisdiction and applicable law

If parts or individual formulations of these terms and conditions of use do not correspond or do not completely correspond with the currently applicable legal position, the content and validity of the other parts shall remain unaffected thereby.The place of jurisdiction is Munich if the user is a Kaufmann [business person] as defined by the HGB [Handelsgesetzbuch, German commercial code].
German law is to apply, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).
The individual national pages of the Comarch Web site are operated by and the responsibility of either Comarch Software und Beratung AG or its subsidiaries. The pages comply with the requirements of the respective country in which the responsible subsidiary has its head office. When users in locations outside the country concerned access the Comarch Web site, they are themselves exclusively responsible for complying with the relevant provisions of the law of the respective country.
